Terms of Service

Agreement

These terms are between you and LABKickstart, Inc. and govern your use of the LABKickstart Portal at portal.labkickst.art (the "Portal"). By signing in and using the Portal, you agree to them. If you do not agree, do not use the Portal.

What the Portal is

The Portal is a tool for teachers to run physics and science labs: to create classes and rosters, monitor a class collecting data live, and, where enabled, keep a gradebook of student lab records. We may add, change, or remove features over time.

Your account

You sign in with Google. You are responsible for your account and for keeping your Google sign-in secure. You must be a teacher, school staff member, or otherwise authorized to use the Portal for a class.

Student information is your responsibility

You are responsible for having the authority, under your school or district policies and applicable law, to enter and use the student information you put into the Portal. You agree to use the Portal only for legitimate educational purposes and to follow your school's and district's policies for handling student data. We act as a service provider processing that information on your and your school's behalf, as described in our Privacy Policy.

Acceptable use

Do not use the Portal to break the law, to store data you are not permitted to store, to interfere with the service or its security, or to access another user's account or class without permission.

Free trial and paid plans

Running your class live is free. Some features, such as the records gradebook, are part of a paid plan that a school can fund; individual teachers are never asked to pay out of pocket. If you start a free trial, the terms shown to you at the time (including the trial length and what happens when it ends) apply. Details of pricing and plans are shown on the Plans page and may change.

Availability and changes

We work to keep the Portal available, but we do not guarantee it will always be uninterrupted or error free. We may update, suspend, or discontinue features, and we will make reasonable efforts not to cause you to lose the records you have created.

Disclaimers and liability

The Portal is provided "as is" and "as available," without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant that the Portal will be uninterrupted or error free, or that data will always be preserved. Please keep your own copies of anything you rely on, including records you export.

To the extent permitted by law, LABKickstart, Inc. is not liable for indirect, incidental, special, or consequential damages arising from your use of the Portal. Our total liability for all claims relating to the Portal is limited to the greater of the amount you paid us for the Portal in the twelve months before the claim, or US$100.

Some places do not allow certain warranty disclaimers or limits on liability, so parts of this section may not apply to you. Nothing in these terms limits any liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute relating to these terms, and you and LABKickstart, Inc. consent to that jurisdiction. If your school or district has signed a separate written agreement with us, that agreement controls wherever it conflicts with these terms.

Changes to these terms

We may update these terms as the Portal changes. We will update the date at the top when we do, and continued use after a change means you accept the updated terms.
